6. Driveway Regulations

Local requirements (unless the zoning ordinance states otherwise):

  • Driveways must be at least 5 feet (152.4 cm) from property lines, dimensioned on the site plan.
  • Maximum driveway width is 14 feet, increased to 20 feet for driveways serving two or more dwelling units or on lots over 70 feet wide.
  • A final inspection is required.

PennDOT Highway Occupancy Permit (HOP):

  • Any driveway installed, altered, or removed where it connects to a State highway requires a PennDOT HOP under Section 420 of the State Highway Law and 67 Pa. Code Chapter 441. Apply through PennDOT’s Electronic Permitting System (EPS).
  • This municipal permit does not replace a PennDOT HOP, and a HOP does not replace this municipal permit.
  • Normally only one driveway is permitted for a residential property on a State highway.
  • An access serving more than three properties is treated as a local road, not a driveway, and must meet road design standards.
  • Work within the road right-of-way must use traffic control per PennDOT Publication 213.

PA Municipalities Planning Code (MPC, February 2022):

  • Under MPC Section 508(6), a plat requiring access to a State highway cannot be finally approved unless it notes that a HOP is required before driveway access is permitted, and it must be marked that access is only as authorized by the HOP.
  • PennDOT must approve, deny, return, or determine no permit is required within 60 days of receiving a HOP application. If PennDOT takes no action within 60 days, the permit is deemed issued.
  • The municipality is not liable for damages arising from PennDOT’s issuance or denial of a driveway permit.

Copy of PennDOT HOP or HOP application (required if connecting to a State highway)
Erosion & sediment control approval from the County Conservation District (if required)
Written authorization from the property owner (if the applicant is not the owner)
HARB approval (required if property is in a Historic District)
Contractor insurance certificate

8. General Requirements

Driveway plans must be mailed, emailed (info@codesassessmentpros.com), or dropped off at our office.

All drawings must be neatly drawn with clean, crisp lettering and must remain legible after reduction for printing. Computer-generated vicinity maps from web-based services are acceptable as long as roadway and street names are legible and will remain so after reduction. Photographs (including digital) must be in focus and correctly exposed.

Although some checklist items may not apply to every project, all applicants are asked to work through the entire checklist. If an item is not necessary, mark it N/A (“not applicable”). This greatly speeds review and approval.

All required fees must be paid before any work begins.

Failure to provide all information will result in the application being deemed incomplete, returned to the applicant and not reviewed. Plan review time will start with a completed application submittal.
